Trade in food supplements

Information for those who wish to get involved in trade in food supplements in Lithuania.

To get engaged in trade in food supplements one must apply to a territorial unit of the SFVS for an Approval Certificate of Food Business Operator or registration of a food business operator.

If one decides to get engaged in trade of food supplements those food supplements have to be notified. If food supplements are imported to the market of Lithuania by several persons each of them has to notify the imported products.

In case of online sale of food supplements when the food supplements are not stored one must register with a territorial unit of the SFVS. Registration of a food business operator refers to the right to get engaged in a food handling activity granted by a territorial SFVS, which is confirmed by assigning an identification number.

If you are going to get engaged in online sale of food supplements and if you are going to store these food supplements you must hold an Approval Certificate of Food Business Operator issued by the territorial unit of the SFVS in the territory of which you are going to carry out your activity.

Approval of a food business operator refers to the right to get engaged in food handling activities granted by a territorial SFVS, which is confirmed by issuing a document – an Approval Certificate of Food Business Operator.

Procedure for issuing an Approval Certificate of Food Business Operator

In case of import of food products a document certifying the safety and quality as well as invoices / delivery notes are required.

The trade in cocktails of food supplements is forbidden in Lithuania. Only delivery of pre-packed food supplements to a final user is allowed.

Notification of food supplements

From 15 April 2016, the State Food and Veterinary Service (SFVS) has to be notified of all the food supplements delivered to the Lithuanian market.

Notification of food supplements introduced from the European Union

Food business operators have to notify the SFVS of food supplements manufactured in Lithuania as well as food supplements for the first time introduced into our country from the EU Member States, the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway and the Swiss Confederation by mail, electronic means or by approaching directly.

A form of Notification of Food Supplements Delivered to the Republic of Lithuania has to be completed and the following documents have to be submitted:

   - an example of the label of the food supplement, which is subject to notification;

   - identification details of the food business operator (name and address of a natural person; name, code and address of a legal person, its branch or agency);

   - contact details of the food business operator (phone and fax numbers, e-mail address);

   - if the introduced and/or imported food supplements are notified by a food business operator of a country other than the Republic of Lithuania it must produce a document which confirms that this business operator is registered or approved in accordance with Article 6 of Regulation (EC) No 852/2004.

Notification of food supplements introduced from third countries

Food business operators shall notify the SFVS of food supplements imported from third countries excluding the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway and the Swiss Confederation by mail, electronic means or by approaching directly.

The form of Notification of Food Supplements Delivered on the Market of the Republic of Lithuania must be completed and the following documents must be submitted:

- example of the label of the food supplement subject to notification;

- identification details of the food business operator (name and address of a natural person; code and address of a legal person, its branch or agency);

- contact details of the food business operator (phone and fax numbers, e-mail address);

- a laboratory test report on the food supplement including the indication of the test method and the confirmation that the amount of nutrients or other substances in the food supplement corresponds to the amounts declared on the label until the date of minimum durability of this product;

- a document issued by the manufacturer of the food supplement with the indication of ingredients of the product and their purpose, amounts of nutrients or other substances with nutritional or physiological effect that are indicated on the label of the food supplement, which also certifies that the food supplement is intended for human consumption and complies with food safety, composition and quality requirements laid down by legislation of the European Union and/or the Republic of Lithuania (when safety, composition and quality indicators of the food supplement are indicated in several documents the collection of these documents shall be provided);

   - a document issued by the competent authority of the country from which the food supplements are imported certifying that the food supplements were manufactured by an entity, which is legally operating in that country under control of the competent institution;

- if there is an ingredient in the composition of the food supplement subject to Regulation (EC) No 258/97 documents certifying that this ingredient is approved as a novel food have to be submitted.

How and where the documents have to be submitted?

The example of the label has to be sent by e-mail maistopapildai@vet.lt whereas the application / notification has to be delivered at the address Siesikų st. 19, LT-07170 Vilnius or by e-mail vvt@vet.lt.

Food supplements included in the Lists of Food Supplements from 01-03-2010 to 31-12-2013 and from 01-01-2014 can be placed on the market. If a decision is taken to stop delivering food supplements included in the Lists of Food Supplements the SFVS must be informed in writing.

The food business operators, which received remarks during notification of food supplements, have to within 30 days adjust their labels and submit the required documents.

Labelling of food supplements

Information on labels of food supplements delivered on the market of the Republic of Lithuania must be given in the Lithuanian language as it is prescribed by Lithuanian Hygiene Norms HN 119:2002 “Labelling of Food Supplements” and HN 17:2010  “Food Supplements”.

In the process of labelling, delivery or advertising food supplements none of them can be assigned any curative and preventive properties or any references to such properties can be made.
